It was actually interesting.
A prostitute is found, age 14. She was forced into prostitution at her
foster home where they failed to notice that the foster mother's
boyfriend is a pimp in the background check.
The child insists she was improperly taken from her father, who never
abused her. She'd broken a bone in her forearm, indicating she'd
protected her face from injury. She said it was volleyball, but the
hospital insisted abuse. In the police investigation, the child's story
was supported and there were witnesses to the game. The police told the >prosecutor there was no crime and the father wasn't indicted, but the
case was still forced into Bronx family court and the father lost
parental rights.
Carisi brings new evidence from Benson's investigation to the father's >attorney but he is unenthused, insisting that Bronx family court sees
little if any justice. The expert witness insisting that there had been
abuse is a pediatrician with a sub specialty in child abuse (Kate
who had reviewed the X-Rays only. Benson is appalled by her attitude and
lack of an open mind.
The episode runs through statistics on the large numbers of single black >mothers and fathers with adverse rulings like these in family courts,
but in truth, this doctor sees only what she wants to see. There's no
racism. She won't have her findings challenged by ignorant cops, social >workers, and lawyers.
Suddenly CJ starts to wonder if she wrongfully convicted a mother of an >infant who had a minor bump on the head that became a crisis. She used
the same doctor as an expert witness.
I didn't care for the cheat. Instead of sticking with a serious
discussion that well-meaning experts can have different conclusions
looking at the same evidence, in the case of the infant, the doctor
ordered a test for a genetic defect that could also present as head
trauma. When the test result was positive, the doctor removed it from
the case file.
Carisi, on CJ's suggestion, conveyned an investigative grand jury,
called the doctor, and got her to perjure herself. She was threatened
with prosecution unless she gave back her medical license.
The children were re-united with their parents. They dropped Carisi's
concern that now they've got to perform a massive review of convictions
in which this woman had testified.
