• Case vs. Montana: The 4th Amendment's Death Knell

    We finally got a final SCOTUS decision in Case v. Montana, 607 U.S. ___
    (2026), Docket No. 24-624 and it wasn?t a good one.

    It wasn?t just some of the conservative justices that were wishy-washy here, they *all* were. A 9-0 decision that says not only do the cops not need a warrant, probable cause, or even reasonable suspicion to forcefully enter your home while in their ?community caretaker? role, if they know you?re a gun owner, the use of even greater force is justified. And it?s justified so they?re better able to protect you. They managed to gut both the 2nd and 4th Amendments with one blow.

    So we can see the idea of "You can take my gun away from my cold dead
    hands" play out in real life. Lovely.

    So we can see the idea of "You can take my gun away from my cold dead
    hands" play out in real life. Lovely.

    It's amazing how they're able to 'interpret' these parts of the Constitution
    to literally say the exact opposite of what the words on the paper mean.

    The peaceful exercise of a guaranteed constitutional right shouldn't give the government more leeway to hurt you. For your own good, of course.

    I haven't done my homework on this case. Please tell me, was this about preventing the estate of the "protected" homeowner from suing for P.I.?

    I'm assuming he was killed in the raid.

    That should perhaps be classified as an irony rather than a truism. Regardless, it doesn't address my practical question.
